What is meant by “adversarial court proceedings”?

Where a settlement order cannot or should not be settled by judicial dunning proceedings, the judicial order must be obtained by means of a dispute procedure.

This is a procedure before the competent court in which a judge decides on the claim after (personally) consulting with the creditors and debtors.

As a result, the total claim is significantly increased by court and legal costs once more.
